1. Data protection at a glance
The following notes give a simple overview of what happens to your personal data when you visit this website. Personal data is any data by which you can be personally identified.
Who is responsible for data collection on this website?
Data on this website is processed by the website operator. You can find their contact details under “Information about the controller” in this privacy policy.
How do we collect your data?
Some data is collected when you provide it to us, for example by email, phone or WhatsApp. Other data is collected automatically by our IT systems when you visit the website. This is mainly technical data (e.g. browser, operating system or time of the page request). This data is collected automatically as soon as you enter this website.
What do we use your data for?
Part of the data is collected to ensure the website is provided without errors and securely. Other data is used to process your inquiries.
Cookies and analytics tools
This website does not set cookies for visitors itself and does not use tracking or web analytics services. Should this change, we will update this privacy policy accordingly and obtain your consent where required.
What rights do you have regarding your data?
You have the right at any time to receive information free of charge about the origin, recipients and purpose of your stored personal data. You also have the right to request correction or deletion of this data. If you have given consent to data processing, you can withdraw it at any time with effect for the future. You also have the right, under certain circumstances, to request restriction of the processing of your personal data. Furthermore, you have the right to lodge a complaint with the competent supervisory authority. You can contact us at any time about this and any other questions on data protection.
2. General information and mandatory disclosures
Data protection
The operators of this website take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy. Please note that data transmission over the internet (e.g. by email) can have security gaps. Complete protection of data against access by third parties is not possible.
Information about the controller
The controller responsible for data processing on this website is:
Arico GmbH
Patershäuser Straße 28
63128 Dietzenbach, Germany
Phone: +49 (0)6071 9849036
Email: [email protected]
The controller is the natural or legal person who, alone or jointly with others, decides on the purposes and means of processing personal data (e.g. names, email addresses).
Storage period
Unless a more specific storage period is stated in this privacy policy, your personal data remains with us until the purpose of the data processing no longer applies. If you assert a legitimate request for deletion or withdraw your consent, your data will be deleted unless we have other legally permissible reasons for storing it (e.g. tax or commercial retention periods); in the latter case, deletion takes place once these reasons cease to apply.
General information on the legal bases of data processing
If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR. If your data is required for the performance of a contract or for pre-contractual measures, we process it on the basis of Art. 6(1)(b) GDPR. We also process your data where required to fulfil a legal obligation on the basis of Art. 6(1)(c) GDPR. Data processing may also be based on our legitimate interest under Art. 6(1)(f) GDPR. The legal bases that apply in each case are explained in the following sections.
Recipients of personal data
In the course of our business we work with external parties. We only pass on personal data to external parties if this is necessary for the performance of a contract, if we are legally obliged to do so (e.g. disclosure to tax authorities), if we have a legitimate interest under Art. 6(1)(f) GDPR in the disclosure, or if another legal basis permits it. When using processors, we only pass on personal data on the basis of a valid data processing agreement.
Withdrawal of your consent to data processing
Many data processing operations are only possible with your express consent. You can withdraw consent you have already given at any time. The lawfulness of the data processing carried out before the withdrawal remains unaffected.
Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)
If data processing is based on Art. 6(1)(e) or (f) GDPR, you have the right to object to the processing of your personal data at any time on grounds relating to your particular situation; this also applies to profiling based on these provisions. The respective legal basis is stated in this privacy policy. If you object, we will no longer process the personal data concerned unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or the processing serves to establish, exercise or defend legal claims (objection under Art. 21(1) GDPR).
If your personal data is processed for direct marketing, you have the right to object at any time to the processing of personal data concerning you for such marketing; this also applies to profiling to the extent it is related to such direct marketing. If you object, your personal data will no longer be used for direct marketing (objection under Art. 21(2) GDPR).
Right to lodge a complaint with the competent supervisory authority
In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work or the place of the alleged violation. This right is without prejudice to any other administrative or judicial remedies.
Right to data portability
You have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a commonly used, machine-readable format. If you request direct transfer of the data to another controller, this will only be done where technically feasible.
Access, correction and deletion
Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of the data processing and, where applicable, a right to correction or deletion of this data. You can contact us at any time about this and any other questions on personal data.
Right to restriction of processing
You have the right to request restriction of the processing of your personal data. You can contact us at any time about this. The right to restriction of processing exists in the following cases:
- If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the verification you have the right to request restriction of processing.
- If the processing of your personal data was or is unlawful, you can request restriction of processing instead of deletion.
- If we no longer need your personal data but you need it to exercise, defend or assert legal claims, you have the right to request restriction of processing instead of deletion.
- If you have objected under Art. 21(1) GDPR, a balancing of your interests and ours must be carried out. As long as it has not been determined whose interests prevail, you have the right to request restriction of processing.
If you have restricted the processing of your personal data, this data may – apart from being stored – only be processed with your consent or to establish, exercise or defend legal claims or to protect the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.
SSL / TLS encryption
For security reasons and to protect the transmission of confidential content, such as inquiries you send to us as the site operator, this website uses SSL or TLS encryption. You can recognise an encrypted connection by the address bar of your browser changing from “http://” to “https://” and by the lock symbol in your browser bar. When encryption is active, the data you send to us cannot be read by third parties.
Objection to promotional emails
We hereby object to the use of contact data published in the imprint for sending promotional and information material that has not been expressly requested. The operators of this website expressly reserve the right to take legal action in the event of unsolicited advertising, for example through spam emails.
3. Data collection on this website
Hosting and content delivery network (Cloudflare)
We use the service “Cloudflare”. The provider is Cloudflare Inc., 101 Townsend St., San Francisco, CA 94107, USA (“Cloudflare”). Cloudflare offers a globally distributed content delivery network with DNS. Technically, the transfer of information between your browser and our website is routed through Cloudflare’s network. This enables Cloudflare to analyse traffic between your browser and our website and to act as a filter between our servers and potentially malicious traffic from the internet. Cloudflare may also use cookies or other technologies to recognise internet users, but solely for the purpose described here.
The use of Cloudflare is based on our legitimate interest in providing our website as error-free and securely as possible (Art. 6(1)(f) GDPR). Data transfer to the USA is based on the EU Commission’s standard contractual clauses, and the company is also certified under the “EU-US Data Privacy Framework” (DPF). More information: https://www.cloudflare.com/privacypolicy/. We have concluded a data processing agreement (DPA) with Cloudflare.
Server log files
The provider of the pages automatically collects and stores information in so-called server log files, which your browser transmits to us automatically. These are:
- Browser type and browser version
- Operating system used
- Referrer URL
- Host name of the accessing computer
- Time of the server request
- IP address
This data is not merged with other data sources. The data is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimisation of its website – for this purpose the server log files must be recorded.
Inquiries by email, phone or fax
If you contact us by email, phone or fax, your inquiry including all resulting personal data (name, inquiry) will be stored and processed by us for the purpose of handling your request. We do not pass on this data without your consent. Processing is based on Art. 6(1)(b) GDPR if your inquiry is related to the performance of a contract or required for pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of inquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if it was requested. The data remains with us until you ask us to delete it, withdraw your consent or the purpose of storage no longer applies (e.g. after your request has been processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.
Communication via WhatsApp
For communication with our customers and other third parties we use, among other things, the instant messaging service WhatsApp. The provider is WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. On this website we only link to WhatsApp; a connection to WhatsApp is only established when you click the link.
Communication is end-to-end encrypted, which prevents WhatsApp or other third parties from accessing the content of the communication. However, WhatsApp does receive access to metadata generated in the course of communication (e.g. sender, recipient and time). According to its own statements, WhatsApp shares personal data of its users with its US parent company Meta. Further details can be found in WhatsApp’s privacy policy: https://www.whatsapp.com/legal/#privacy-policy.
WhatsApp is used on the basis of our legitimate interest in fast and effective communication with customers, prospective customers and other business partners (Art. 6(1)(f) GDPR). The communication content exchanged remains with us until you ask us to delete it or the purpose of storage no longer applies (e.g. after your request has been processed). Mandatory statutory provisions – in particular retention periods – remain unaffected. The company is certified under the “EU-US Data Privacy Framework” (DPF).
4. Our social media presence
This privacy policy applies to our profiles on Instagram (instagram.com/arico_machine_tools) and YouTube (youtube.com/@aricomachine2961). On this website these profiles are only linked; no content is embedded and no data is transmitted to the networks unless you click the links.
Data processing by social networks
We maintain publicly accessible profiles on social networks. Social networks can usually analyse your user behaviour comprehensively when you visit their website or our social media presence. If you are logged in to your social media account and visit our presence, the operator can assign this visit to your user account. Your personal data may also be collected if you are not logged in or do not have an account, e.g. via cookies or by recording your IP address. Using the data collected, the operators can create user profiles containing your preferences and interests so that interest-based advertising can be displayed. We cannot trace all processing operations on the platforms; for details please refer to the privacy policies of the respective providers.
Legal basis, responsibility and your rights
Our social media presence is intended to ensure the widest possible presence on the internet. This is a legitimate interest within the meaning of Art. 6(1)(f) GDPR. We are jointly responsible with the operator of the respective platform for the data processing operations triggered by your visit. You can in principle assert your rights (access, correction, deletion, restriction of processing, data portability and complaint) both against us and against the platform operator. We have no influence on the storage period of data that the operators store for their own purposes.
The provider is Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland.
